Germany: All forums criminal?

A court in hamburg adjudged a journalist and blogger, Stefan Niggemeier, because there was an offensive statement posted as a comment on a entry which was several moths olds. Niggemeier deleted it immediately when he saw it but the court said that this was not enough.
The judge says that Niggemeier was liable even for the fact that the offensive comment was published.
Earlier, several courts including the Bundesgerichtshof (Federal Court) decided that it's not reasonable to claim the absolute knowledge of all posts and that it's enough to delete offensive comments if someone points them.
If this example was usual law, nearly every forum or blog was criminal. Seems as if the german courts want to show their absolute ignorance towards the new media once again -.-
